The 510(k) application process takes its name from Section 510(k) of the Federal Food, Drug, and Cosmetic Act (FD&C Act), which requires device manufacturers to notify the FDA before introducing a new medical device to market. The process itself follows a defined sequence: confirming that a 510(k) is required, identifying an appropriate predicate device, determining device classification, compiling supporting data, preparing and submitting the formal notification, and undergoing FDA review. A successful submission concludes with an FDA determination of substantial equivalence (SE), allowing the device to be legally marketed under the FD&C Act. The sections below outline each step of this process in detail, along with the post-clearance obligations manufacturers must continue to meet and the common missteps that can delay or complicate a submission.

What is a 510(k)?

A 510(k) is a premarket submission made to the FDA necessary to legally market low-to-moderate-risk medical devices in the U.S. The aim of a 510(k) submission is for manufacturers to prove the submitted device is Substantially Equivalent (SE) to an already marketed predicate device, showing it is just as safe and effective. An SE determination by the FDA then allows the product to be legally marketed per the FD&C Act.

When is a 510(k) required? 

Barring certain exemptions, a 510(k) submission is required before marketing a low-to-moderate-risk medical device for the first time in the U.S., or when an existing legally marketed device undergoes changes or modifications that could significantly alter its safety, effectiveness, or intended use. 

510(k) Submission Step-by-Step 

  1. Determine if a 510(k) is required and identify a predicate 
    • Ensure your device isn’t exempt and actually needs a 510(k) based on its classification and intended use. Find a legally marketed device with the same intended use and similar technological characteristics to serve as the basis for your substantial equivalence claim. This is the foundation of the submission. 
  2. Determine device classification 
    • Confirm your device’s classification. Gather supporting technical, performance, and (if needed) clinical data needed to demonstrate substantial equivalence to the predicate. 
  3. Prepare the 510(k) submission 
    • Assemble the formal submission package, which typically includes the following: 
      • Device description 
      • Indications for use statement 
      • Substantial equivalence comparison/discussion 
      • Performance testing summaries 
      • Proposed labeling 
      • Administrative documentation (cover letter, etc.) 
  4. Submit to the FDA 
    • Submit the 510(k) electronically, along with the applicable user fee (unless exempt). 
  5. FDA Review 
    • The FDA performs an initial screening (Refuse to Accept review) to confirm the submission is administratively complete before substantive review begins. FDA reviewers then evaluate the submission for substantial equivalence. This stage may involve one or more rounds of Additional Information (AI) requests from the manufacturer 
  6. FDA decision 
    • The FDA issues one of the following: Substantially Equivalent (SE) — clearance granted, device may be marketed, OR Not Substantially Equivalent (NSE) — device cannot be marketed via 510(k); other pathways (like De Novo or PMA) may be necessary 
  7. Post-clearance obligations 
    • Once cleared, the manufacturer must comply with ongoing FDA requirements, including registration and listing, labeling accuracy, and Quality System (QS) regulation compliance, and must evaluate whether future modifications require a new 510(k). 

 

Common Misconceptions and Missteps 

Necessarily, the 510(k) clearance process is an involved and technical one that can be difficult for manufacturers to navigate. A shortlist of sticking points the Accorto Team has identified is as follows: 

  1. Substantial Equivalence Misunderstandings 
    Many regulatory misconceptions exist around substantial equivalence. Manufacturers should be wary of equating market similarity with substantial equivalence; it is important to understand that the method to gain 510(k) SE clearance is not for the manufacturer to demonstrate there is a device similar to the applicant product. SE clearance requires the manufacturer to demonstrate that the applicant device is as safe and effective as a legally marketed predicate despite any differences. In short, a predicate is not simply a product that looks similar, nor is it an identical device; it is a regulatory comparison and should be established in the 510(k) using all appropriately evidentiary verified data and documentation thereof. 
  2. Regulatory Strategy Incorporation in Design Process 
    Many misconceptions and deficiencies stem from manufacturers attempting to collate documentation and find the correct pathway to market for their product after that product is fully designed and developed. Incorporation of regulatory strategy early in the design process can avoid engineering around assumptions that later prove incompatible with the intended regulatory pathway. Actions intended to mitigate regulatory uncertainty, such as intentionally reducing novelty and risk factors, can make for a stronger 510(k) application. In short, a strong 510(k) reflects decisions made throughout development; therefore, it is prudent to consider regulatory strategy at every phase to present a coherent narrative in which the intended use, technological characteristics, risk analysis, testing, labeling, and conclusions all reinforce one another in demonstrating SE. 
  3. Intended Use Information and Labelling 
    The Intended Use Statement and accompanying labelling are some of the most important documents in the 510(k) submission because the FDA uses them to determine the framework applied. The smallest of changes in phrasing can significantly change the classification, predicate availability, testing requirement, and applicable regulation. Therefore, it is critical not to formulate labelling and Intended Use information last or as an afterthought. When these components are developed early they strengthen the overall regulatory package and can help minimize additional questions during FDA review. 
  4. Testing and Evidentiary Burden 
    Every product application submitted to the FDA under every pathway bears a weight of evidentiary burden that each particular pathway imparts, so it is important that the testing done on any product be appropriate to demonstrate the actual evidence being requested. To this end, bench testing, while valuable, is not always enough. Manufacturers should ensure that the testing completed answers the regulatory questions being asked in the application: bench testing for performance questions, human factors testing for safe use, electrical testing for electrical safety, and so on and so forth. Even excellent products can receive Additional Information requests if the evidence is incomplete, so supporting testing data must be topical and well-organized.  

The Bottom Line 

Successfully obtaining FDA 510(k) clearance requires far more than completing a submission checklist. It depends on developing sound regulatory strategy from the earliest stages of device development, selecting an appropriate predicate, generating evidence that directly supports the intended claims, and maintaining consistency across the intended use, testing, risk management, and labeling. While the process can be complex, manufacturers who understand the FDA’s expectations and proactively address common pitfalls are better positioned to achieve an efficient review and avoid unnecessary delays.
